Cyber Law and It Act
Cyberlaw is a generic term which refers to all the legal and regulatory aspects of internet and the World Wide Web. Anything concerned with or related to or emanating from any legal aspects or issues concerning any activity of netizens and others, in Cyberspace comes within the ambit of Cyberlaw. The growth of Electronic Commerce has propelled the need for vibrant and effective regulatory mechanism which would further strengthen the legal infrastructure, so crucial to the success of Electronic commerce. All these regulatory mechanisms and legal infrastructures comes within the domain of Cyberlaw
Cyberlaw is important because it touches almost all aspects of transactions and activities on and concerning the internet, the World Wide Web and Cyberspace.
India’s IT Act and IT (Amendment) Act, 2008
In India the cyber laws are enforced through Information Technology Act, 2000 (IT Act 2000) which was notified on 17 October 2000. It is based on the United Nation’s Commission for International Trade related laws (UNCITRAL) model law.
IT ACT 2000’s prime purpose was to provide legal recognition to electronic commerce and to facilitate filing of electronic records with the government, i.e., provide the legal infrastructure for e-commerce in India.
The Act was later amended in December 2008 through the IT (Amendment) Act, 2008. It provided additional focus on information security. It has added several new sections on offences including Cyber Terrorism and Data protection. The Information Technology Amendment Act, 2008 (IT Act 2008) came into force from October 27, 2009 onwards. Major amendments of IT ACT (2008) included:
